Running, Wise & Ford has an active and extensive practice in creditors' rights, bankruptcy, and collections. We regularly represent secured creditors, debtors, creditors' committees and trustees in Chapter 11 and Chapter 7 proceedings, loan work-outs, defense of preference claims, fraudulent transfer avoidance actions, reclamation claims, collection suits, foreclosure actions and related matters. We proactively work with businesses to structure transactions designed to anticipate bankruptcy problems.

Our attorneys have great expertise in commercial and real estate lending, both secured and unsecured. We successfully represent clients in complex federal and state court litigation and appeals relating to loan enforcement, commercial law, lender liability claims, fraudulent business schemes and fraudulent transfers. Our attorneys are well versed in foreclosure law, both judicial and non-judicial. Our strategies include working out-of-court with various creditor and customer constituents, preparing and filing for Chapter 11 relief and addressing issues across multiple legal disciplines. We believe it is critical to develop a well thought out and realistic plan as early in the process as possible. This approach creates realistic expectations of the various constituents to a work-out or bankruptcy and maximizes the opportunity to be successful and minimize costs.

    A bankruptcy trustee has the right to liquidate any property of a Chapter 7 Debtor subject to claimed exemptions and liens.
